Risk and Danger Acknowledgment. I understand and acknowledge that (a) the activities in the gathering have inherent dangers that no amount of care, precaution, instruction, or experience can eliminate; (b) there are areas on the grounds, including cenotes, lakes, streams, rivers, and trees, which may be dangerous; (c) the use and enjoyment of the Property and the activities of the Gathering require effort and skill levels that may range from moderate to very high, depending on how you choose to use and enjoy the Gathering and the Property; (d) the Property is located in a somewhat remote, rural to semi-wild area, and there may not be quick access to medical attention, if any; (e) due to the natural, remote environment of the Property, nighttime lighting is minimal, and there is a risk of slips, falls, and collisions with natural and man-made objects.

Responsibility (f) It is my responsibility to exercise due care in the use and enjoyment of the Property and the Gathering; (g) the inherent risks during my use of the Property and the Gathering may arise as a result of man-made and/or natural conditions, and not all hazardous conditions will be easily evident, marked as dangerous, or made safe before my use and enjoyment of the Property and the Gathering; (h) these inherent risks include, among others, tripping, burns, falling branches, etc., unknown or hidden hazards on the premises, natural hazards, uneven and dangerous terrain, wildlife, insect stings, careless behavior by myself or others, errors in judgment by the owners or creators of Tierra de Rosas :: AMAR; (j) potential injuries range from mild muscle pain, bruises, sprains, abrasions, and lacerations to more serious injuries such as ankle sprains, bone fractures, knee injuries, shoulder injuries, back sprains, neck sprains, internal injuries to vital organs, closed head trauma, and chipped or broken teeth, as well as catastrophic injuries such as permanent disabilities, spinal injuries, paralysis, and even death.

Acceptance of Risks. I expressly and voluntarily assume all risks during my participation in the Activities or any aspect of the Gathering, whether caused by negligence of Tierra de Rosas :: AMAR and any of its owners, directors, employees, representatives, agents, contractors, or volunteers (collectively, the "Released Parties"). I understand that my use and enjoyment of the Property and the Gathering and the Activities involve inherent risks, both described in this document and other risks, which are serious and may involve dangers regardless of the care taken by Tierra de Rosas :: AMAR or the Released Parties. I recognize that my use and enjoyment of the Property and the Gathering and participation in the Activities require a certain degree of skill, coordination, and physical fitness. I have read the preceding paragraphs and understand the nature of the Property, the Gathering, and the Activities, I understand the demands placed on me regarding my physical condition and skill level, and I appreciate the types of injuries that may occur as a result of such activities. I hereby acknowledge that my participation in the use and enjoyment of the Property, the Gathering, and the Activities is voluntary, and I consciously assume all inherent risks related to the Property, the Gathering, and the Activities, both described in this document and other currently unknown risks. Tierra de Rosas :: AMAR cannot provide personal support for attendees. If you believe you may need personal support, Tierra de Rosas :: AMAR will require you to purchase an additional ticket for that person.

Medical Responsibility. I consent to receive medical treatment deemed necessary in case of injury, accident, or illness during the Gathering, and I authorize Tierra de Rosas :: AMAR and any first aid personnel at the Gathering to administer emergency first aid, CPR, use any necessary medical devices, and ensure emergency medical care or transportation if Tierra de Rosas :: AMAR deems it necessary, and I accept responsibility for the payment of all emergency medical care and transportation costs. I hereby release Tierra de Rosas :: AMAR, the Released Parties, and all persons participating in providing well-being, first aid, or any medical treatment for me during the Gathering from any liability or obligation related to providing me with first aid suggestions, my decisions regarding what type of well-being, first aid, or medical assistance to use, and any emergency first aid provided. Participants with known acute or chronic medical conditions are (a) solely responsible for managing their condition during the Gathering, (b) required to provide all accommodations, medications, medical equipment, and other services necessary to ensure their condition is properly attended to and monitored during their time at the Gathering, (c) must seriously consider bringing a medical assistant with a ticket/companion to help monitor their condition during their time at the Gathering if necessary, and (d) are encouraged to alert Tierra de Rosas :: AMAR of their acute or chronic condition if necessary.

Health Acknowledgments: I acknowledge and/or accept the following. The safety of all attendees and participants is paramount. Participants and attendees will act with the utmost respect for the safety of others at the event. Tierra de Rosas :: AMAR cannot guarantee that participants or attendees will not contract COVID-19, its variants, or any other infectious disease. By attending the event, you agree to assume all risks. Your attendance is voluntary, and you consciously accept all health-related risks, including risks related to infectious diseases such as COVID-19, even if arising from the negligence or fault of another party. By entering the gathering, you acknowledge that you understand and will comply with the above health and safety requirements and agree to assume all risks.

Release and Waiver of Liability. I release and discharge the Released Parties from all liability, claims, demands, or causes of action I may have in the future for injury, damage, or death arising from my participation in the Gathering and the Activities and use of the Property. I hereby release, waive, discharge, and agree not to sue the Released Parties and discharge them from all liability for all claims arising from my use and enjoyment of the Property and the Gathering and the Activities, including any injury resulting from ordinary negligence by the Released Parties.

Indemnification. Furthermore, I agree to indemnify, defend, and hold harmless the Released Parties from any liability for any judgment, cost, damage, including investigation costs, legal fees, expert fees, and costs and expenses related to lawsuits, litigation, arbitrations, and/or mediations related to all and any claims made against Tierra de Rosas :: AMAR or any of the Released Parties in connection with any conduct on my part at the Gathering and the Property, or of the persons I registered to attend the Gathering, including any injury or loss due to ordinary negligence of the Released Parties.

Phone Use. I agree to respect phone use during times dictated by Tierra de Rosas :: AMAR and place it in the designated spaces by the organizers, whether to communicate with others or take photographs of the gathering. I agree to respect the privacy of attendees and not violate the space.

Photographs Allowed. While general photography is prohibited except for personal use and the roll camera provided, Tierra de Rosas :: AMAR records certain events or programs, using professionals to take official photos and videos. Our commitment is and always will be to care for your privacy, so the designated person to create the record will only access the practices indicated without violating the space, intimacy, or process of the attendees. By entering the Property and attending the Gathering, you agree that Tierra de Rosas :: AMAR may participate in photographs, audio recordings, and video recordings that may include your image or voice, and you agree to the ability of Tierra de Rosas :: AMAR to choose content to publish, display, or reproduce the images or recordings to promote the gatherings and similar events. If you do not wish to be photographed during the event, you must email or contact the organizers 10 days before the event.
